Vadim Novinsky has applied to the constitutional court declared unconstitutional the law on the forced renaming of the UOC

Вадим Новинский обратился в конституционный суд о признании неконституционным закона о насильственном переименовании УПЦ

People’s Deputy of Ukraine, head of the faction Opposition bloc Vadim Novinsky in representation of 49 people’s deputies appealed to the constitutional Court of Ukraine with idea of recognition unconstitutional the law of Ukraine “On amendments to the Law of Ukraine “On freedom of conscience and religious organizations” of December 20, 2018 No. 2662-VIII, which illegally requires the canonical Ukrainian Orthodox Church to change the name.

“Anti-Church bill on the forced renaming of the Ukrainian Orthodox Church voted in violation of constitutional procedures. 84th article of the Constitution obliges deputies to vote in person. We were all witnesses as 20 December last year, during the voting of the bill in the session hall was recorded a few cases of Ghost voting. Of the 240 cards of registered people’s deputies voted for the bill, 23 were not registered on the voting day in the hall, and two were on sick leave that is documented by the VR”, — said Vadim Novinsky. “We have the precedent of the abolition of the Constitutional Court of the laws “On principles of state language policy” and “On national referendum” on the basis of violations of the constitutional procedure, namely, non-personal voting”.

According to him, article 24 of the Constitution prohibits discrimination against citizens on any grounds. At the same time, the contested law is required to change the name and re-register the statutes of the communities only one denomination – the Ukrainian Orthodox Church — not obliging the others, and that is discrimination. The law is also in violation of the 35th article of the Constitution and the provisions of the Law on freedom of conscience, guaranteeing non-interference of state in Church Affairs, including the right of communities to freely choose and to change spiritual centres in Ukraine and abroad. According to the norms of Ukrainian law, religious communities generally are not required to register their statutes. In addition, the introduction of the bill in the agenda and voting in the morning and not the evening session was a violation of parliamentary Rules, another blatant violation was that he voted as a whole, despite the amendments of the Opposition bloc.

“The only public institution that is trusted by Ukrainians, left the Church. The government threatens the rights of the largest denomination in Ukraine is the Ukrainian Orthodox Church, where parishioners can be denied the right to freedom of conscience and religion. We will defend the Constitution, rule of law and the rights of believers in Ukraine”, — said Vadim Novinsky.

We will remind, the Opposition bloc is contesting in the courts the illegal disenfranchisement of three million citizens.

As reported Politeka, the faction of the Opposition bloc left the hall of the Verkhovna Rada.

Also Politeka wrote that the Opposition bloc demanded the abolition of the discriminatory decisions of the CEC.
