Entered into force the law on the simplification of extradition

In Ukraine came into force the law, which regulates the simplified procedure of extradition of persons detained in connection with the stay in the international wanted list.

The relevant law “On amendments to the criminal procedure code of Ukraine in connection with ratification of the Third additional Protocol and the Fourth additional Protocol to the European Convention on extradition” released yesterday, November 3, in the parliamentary newspaper “Voice of Ukraine”.

“This law shall enter into force on the day following the day of its publication”, — is spoken in documents.

As reported, the Verkhovna Rada on 2 October adopted the law “On amendments to the criminal procedure code of Ukraine in connection with ratification of the Third additional Protocol and the Fourth additional Protocol to the European Convention on extradition of offenders” (No. 6149).

The law allows detainees who are wanted internationally, ask about the use of simplified procedure of extradition without waiting for the formal request for extradition.

By law, the transfer of the person in respect of whom the decision on extradition under the simplified procedure shall be made within 10 working days from the date of notification of the competent authority of the foreign state about the decision. This period may be extended by an authorized (Central) authority of Ukraine within 30 days. Delaying the actual transfer of persons on the grounds provided by article 592 of the Code, is not allowed.

It is envisaged that in the case of adoption by an authorized (Central) authority of Ukraine of a decision to refuse the extradition of a person (extradition) in a simplified manner the results of the person (extradition) is carried out according to the General rules of extradition of persons who committed a criminal offence.

The law authorized body of Ukraine may take a decision on extradition under the simplified procedure or refusal within five working days from the date of receipt of the decision of the investigating judge who approved the consent of the person for extradition, and information of the competent authority of a foreign state.
