 Baldwin Trial: Lawyers' Petition Fails

Alec Baldwin's lawyers are trying to get the special counsel suspended in a case against an actor over a fatal shot at a cameraman on the set of Rust in New Mexico.

Associated Press reports.

In the petition, Baldwin's lawyers said that Andrea Rieb's position as a state member of the House of Representatives prohibited her by law from holding any -or powers in a judicial capacity.

“Rib exercises either executive or judicial power, and her continued service as a special prosecutor is unconstitutional,” — lawyers said.

Reeb is a Republican elected to the state House of Representatives in November. Her term in office began last month.

Santa Fe District Attorney Mary Carmack-Oltvis rejected the idea of disqualifying Reeb. The motion was characterized as a legal diversion.
