The dismissal of pregnant women: what rights do Ukrainian mother

In Ukraine, pregnant women and women with children up to three years can not free enterprise. The only exception is a complete liquidation of the company, informs Rus.Media.

What rights, according to the legislation of Ukraine are pregnant women and women with young children (under three years).

According to Ukrainian legislation, one of the grounds for termination of the employment contract is the expiry of labour contract, except cases when labor relations actually continue and neither of the parties has demanded their termination, under paragraph 2 of part 1 of article 36 of the Labor code of Ukraine.

The labor code of Ukraine (part 3 of article 184), stipulates that the dismissal of pregnant women and women with children under the age of three years (six years part 6 of article 179 of the Labor code of Ukraine), single mothers in the presence of a child under 14 or a child with a disability on the initiative of owner or authorized body is not allowed, except for cases of full liquidation of the enterprise, institution, organization, when dismissal is allowed with a mandatory employment.

These women in cases of dismissal after the end of fixed-term employment contract must be employed.

The period of employment for their previous wages, but not more than three months from the date of termination of an employment contract.

Three-month period is calculated not from the date of dismissal, from the date of termination of an employment contract. The expiration of the employment contract does not give grounds for automatic release.
